Scope of the Law of Persons and Common Fundamental Disputes

The law of persons constitutes the first book following the introductory provisions of the Turkish Civil Code and is the cornerstone of civil law. It regulates who the entities capable of holding rights and obligations are in the legal order, their capacities, the beginning and end of personality, personal rights, and their protection.

Fundamental Principles of the Law of Persons

The law of persons guarantees the fundamental rights and statuses that individuals possess from birth. The capacity to exercise civil rights, the inalienability and waiver-prohibited nature of personal rights, the protection of personality, and the rule of good faith constitute the fundamental building blocks of the law of persons.

Common Fundamental Disputes in Personal Life

In practice, a wide range of legal disputes and litigation matters arise, ranging from legal capacity to guardianship procedures. The most frequently encountered types of disputes are:

  • Lawsuits for Compensation Arising from Attacks on Personal Rights: These are material and moral compensation lawsuits, as well as lawsuits for the cessation/prevention of the attack, filed in cases of unlawful attacks on personal values such as honor, dignity, private life, voice, and image.
  • Lawsuits for Change and Correction of First and Last Names: These are non-contentious judicial matters filed to change or correct a first or last name in the population registry in the presence of justified grounds (such as the name being ridiculous, causing difficulties in social relationships, spelling errors, etc.).
  • Lawsuits for Correction of Age and Gender: These are lawsuits filed to update the legal status when the age record in the population registry contradicts the actual situation, or following a gender change within the framework of medical necessities and legal conditions.
  • Disputes Concerning Declaration of Death and Presumption of Death: These are processes for obtaining a declaration of death for individuals from whom no news has been received for a long time or who have disappeared under life-threatening circumstances in order to resolve their asset and inheritance relations, along with the associated property disputes.
  • Guardianship, Trusteeship, and Legal Consultancy Procedures: These are disputes involving the appointment of a guardian or trustee for adult persons who, despite having the power of discernment, cannot handle their own affairs or need a legal representative due to reasons such as age, extravagance, alcohol/substance addiction, a custodial sentence, or severe illness, as well as objections raised against the decisions of guardianship organs.

Key Considerations in Legal Proceedings

Since disputes regarding the law of persons directly affect individuals' status, identity, and legal position in social life, they require great sensitivity. Particularly in attacks on personal rights, paying attention to the forfeiture periods (hak düşürücü süreler) and statutes of limitations prescribed for compensation and prevention lawsuits, and fully fulfilling the burden of proof and procedural rules in situations such as guardianship and population record corrections, are of critical importance for ensuring legal security.
