Scope of Consumer Law and Common Disputes
Consumer law is a specialized branch of law focused on protecting the weaker party, bringing together natural or legal persons acting for commercial or professional purposes (seller/provider) on one side, and natural or legal persons acting for non-commercial or non-professional purposes (consumer) on the other. Shaped by Law No. 6502 on the Protection of Consumers, this field secures shopping transactions and service contracts at almost every stage of daily life.
Fundamental Principles of Consumer Law
At the foundation of consumer law lies the protection of the individual consumer against market imbalances and providing safeguards against non-negotiable standard contract terms (unfair terms) between the parties. The law grants consumers alternative rights against defective goods and services, and provides deterrent protection mechanisms such as rights of withdrawal in door-to-door sales, distance contracts (e-commerce), and subscription agreements.
Common Disputes Encountered in Consumer Life
The primary types of disputes brought before consumer arbitration committees and consumer courts in practice are as follows:
- Defective Goods and Services Disputes: Disagreements arising from demands for returns, replacements, repairs, or price reductions when a purchased product (electronic appliances, white goods, automobiles, etc.) or a provided service (renovations, travel, maintenance, etc.) fails to possess the promised features, turns out to be broken, or malfunctions in a short period.
- Distance Contracts and E-Commerce Disputes: Grievances experienced due to the failure to honor the 14-day legal right of withdrawal in online shopping, delayed or defective delivery of products, unilateral cancellations of orders, and misleading advertisements on websites.
- Housing Finance and Housing Sales Contracts (Prepaid Housing): Disputes regarding unfair and exorbitant file fees in housing loan (mortgaged loans) contracts, early payment penalties, and failure to make timely deliveries or execute title deed transfers in housing sales from a project.
- Subscription Agreements (GSM, Internet, Electricity, Water, Natural Gas): Difficulties encountered in terminating subscriptions, unjust withdrawal penalties reflected in committed contracts, unlawful additional fees reflected on invoices, and meter reading fee disputes.
- Timeshare (Devre Tatil) and Property Timeshare (Devre Mülk) Disputes: Failure to provide the services promised in timeshare contracts marketed for vacation purposes, difficulties experienced during the processes of withdrawal from the contract, and unfair termination penalties.
Key Considerations in Legal Proceedings
Paths to seeking justice in consumer disputes are determined according to monetary limits. While it is mandatory to first apply to Consumer Arbitration Committees for disputes remaining below a certain monetary threshold, resorting to mediation before filing a lawsuit is a prerequisite for disputes above this limit. To protect their rights, it is extremely important for consumers to keep evidence such as invoices, receipts, warranty documents, and written contracts, and to comply with legal application deadlines.
